Conditions to reissue work permit

1. A work permit with the term of validity of at least 5 days, but not over 45 days
2. Being approved in writing by the competent state agencies on the use of foreign workers
3. The worker has an expired work permit and continue working in the same position.

Documents required for work permit re – issuance because of expiration.

1. Written request for work permit re – issuance application of the employer under the provisions of the Ministry of Labor, Invalids and Social Affairs
2. 2 color photos (size 4cm x 6cm, white background, front, bareheaded, without sunglasses), taken within 6 months prior to the application date.
3. Original current work permit
4. Written approval to the employer on the use of foreign worker for the job position
5. Certified copy of passport
6. Medical Certificate
7. Written proofs the foreign worker and the employer continue working together.

The application procedures for reissuing work permit

1. If the work permit expires before at least 5 days, but not over 45 days, the employer shall submit the dossier to the Ministry of Labor – Invalids and Social Affairs or the Department of Labor – Invalids and Social Affairs to reissuing work permit.
2. Time to process: 05 working days to get a work permit. In case of not reissuing work permit, there shall be a reply in writing and clearly state the reason.

1. After the foreign worker is granted work permit, the employer shall carry out signing labor contract with the person who is granted work permit in accordance with Vietnam law.

Enterprise must report on the use of foreign worker to the Department of Labor – Invalids and Social Affairs. Work permit is the original or the certified copy.

How long is the validity term of re- issuance work permit?

The term of the re – issuance work permit shall not over 2 years.
